By accessing or using Chowfly's services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. Description of Services

Chowfly provides restaurant delivery optimization services, including:

• FlyScore calculation and analysis
• Menu profitability analysis
• Automated pricing recommendations
• Customer retention tools
• Google Business optimization
• Integration with third-party delivery platforms

3. Account Registration

To use our services, you must:

• Be at least 18 years old
• Have the authority to bind your business to these terms
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access

4. Subscription and Payments

Billing: Paid plans are billed monthly in advance. All fees are non-refundable except as expressly set forth in these Terms.

Free Trial: If we offer a free trial, you will not be charged until the trial period ends. You may cancel at any time during the trial.

Cancellation: You may cancel your subscription at any time. Upon cancellation, you will continue to have access until the end of your current billing period.

30-Day Guarantee: If you don't see measurable improvement in your FlyScore within 30 days of using our Pro or Growth plans, we'll refund your first month.

5. Acceptable Use

You agree not to:

• Use the service for any illegal purpose
• Violate any applicable laws or regulations
• Infringe on the rights of others
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Reverse engineer or attempt to extract source code
• Use the service to send spam or unsolicited communications

6. Intellectual Property

Our Property: Chowfly and its licensors own all rights to the service, including FlyScore methodology, algorithms, software, and branding.

Your Data: You retain all rights to your business data. By using our service, you grant us a license to use your data to provide and improve our services.

7. Third-Party Integrations

Our service integrates with third-party platforms (DoorDash, UberEats, etc.). Your use of these integrations is subject to the respective third party's terms of service. We are not responsible for the actions or policies of third parties.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY SPECIFIC RESULTS WILL BE ACHIEVED.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHOWFLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

10. Indemnification

You agree to indemnify and hold harmless Chowfly from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

11. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes through the service or by email. Your continued use after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any disputes shall be resolved in the courts of Travis County, Texas.
